Under the Aegis: Unveiling the Process After a Guardian’s Report Reaches the Court
Discover the crucial steps that unfold after a Guardian ad Litem submits their report to the court. Learn how these reports influence judicial decisions and the ongoing advocacy efforts that Guardians undertake to ensure the best outcomes for children.
At TIGALA, the role of a Guardian ad Litem extends far beyond simply submitting a report to the court. Once a Guardian’s report reaches the court, it triggers a meticulous and collaborative process involving all parties to the proceedings. Each party, including Tusla, (the Child and Family Agency) and the child’s parents, reviews the report with their legal representatives. The Guardian then stands ready to give evidence and answer any questions from the judge or undergo cross-examination from other parties.
The court relies on the Guardian's report, which reflects the child’s wishes, feelings, and the Guardian’s professional assessment of what is in the child’s best interests. This information plays a pivotal role in the judge's final decision regarding the child’s welfare. However, the Guardian’s involvement doesn't end here. They also attend critical meetings such as child-in-care reviews, continuing to advocate for the child’s best interests in these settings.
We make our own assessment in relation to what we believe as professionals is in the best interests of the children that we serve, and we advocate these to the other stakeholders in the child's life.
The Guardian's ability to collaborate with various stakeholders, including parents and Tusla, is vital to ensuring the best outcomes for the child. Through their comprehensive assessments and active involvement in both court proceedings and other significant meetings, Guardians ad Litem like those at TIGALA work tirelessly to enhance the welfare and future of the children they serve.
This process, meticulously followed after a Guardian’s report reaches the court, underscores the importance of their role in shaping the future of vulnerable children. Watch the video from TIGALA Director & Guardian ad LItem Claire Quinn below to find out more.
